These conditions of sale are concluded on the one hand by the company SARL BAM Production whose head office is located at 418 Chemin du Mas de Paran 30900 Nîmes and on the other hand, by any natural or legal person wishing to make a purchase. via the website www.bam-superfruits.com
Object
These conditions of sale are intended to define the contractual relationship between SARL BAM Production and the buyer and the conditions applicable to any purchase made through the commercial site www.bam-superfruits.com, whether the buyer is a professional or consumer. The acquisition of a property through this site implies unreserved acceptance by the buyer of these conditions of sale. These conditions of sale shall prevail over any other general or specific conditions not expressly approved by SARL BAM Production. SARL BAM Production reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.
Characteristics of the goods offered
The products are those which appear on the site www.bam-superfruits.com. These products are offered within the limits of available stocks. Each product is accompanied by a description drawn up by SARL BAM Production. The photographs are as faithful as possible but cannot ensure a perfect similarity with the product offered, in particular with regard to the colors.
Prices
The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs. SARL BAM Production reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The products remain the property of L'entreprise SARL BAM Production until full payment of the price. The global price indicated in the order confirmation is the final price. This price includes the price of the items, the packaging costs, the transport costs, as long as they take place in the geographical areas provided.
Geographical area
The online sale of the products offered on the site is reserved for buyers who reside in metropolitan France.
Orders
The buyer, who wishes to buy a product, must:
- complete the identification form on which he will indicate all the contact details requested or give his client number if he has one;
- complete the online order form giving all the references of the chosen products;
- validate his order after having checked it;
- make the payment under the conditions provided;
- confirm their order and payment.
Confirmation of the order entails acceptance of these conditions of sale, acknowledgment of having perfect knowledge of them and waiver of its own conditions of purchase or other conditions. The seller will communicate by e-mail confirmation of the registered order.
Withdrawal
Buyers, non-professional individuals, do not benefit from a withdrawal period given the food nature of the products, in accordance with the law.
Payment terms
The price is payable when ordering. Payments will be made by credit card; they will be carried out through the secure system. The buyer's account will only be debited when the available products are dispatched and the amount of the products sent. At the request of the buyer, he will be sent a paper invoice.
Deliveries
Deliveries are made to the address indicated in the order form, which can only be in the agreed geographical area, i.e. in Metropolitan France. The transfer of ownership of the goods takes place as soon as the goods leave the premises of SARL BAM Production. The risks are borne by the purchaser from the moment the products have left the premises of SARL BAM Production. In the event of damage during transport, the reasoned protest must be made to the carrier within three days of delivery. Delivery times are only given as an indication; if these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. In the event of deliveries by a carrier, the company SARL BAM Production cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several appointment proposals.
Guarantee
All the products supplied by the seller benefit from the legal guarantee provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned to the seller who will take it back, exchange it or refund it. The seller, in the online sales process, is only bound by an obligation of means; its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.
Responsibility
The products offered comply with the French legislation in force. SARL BAM Production cannot be held liable in the event of non-compliance with the legislation. Furthermore, SARL BAM Production cannot be held liable for damages resulting from improper use of the purchased product. Finally, SARL BAM Production cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

Archiving - Proof
SARL BAM Production will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The computerized registers of SARL BAM Production will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
Litigation
These online sales conditions are subject to French law.
In the event of any dispute over the interpretation or execution of these conditions and after the failure of any attempt to find an amicable solution, express jurisdiction is attributed to the French courts, and in particular to the Commercial Court of Nîmes. .
